4. ESTIMATES AND PRICING

4.1 Free Estimates: We offer free estimates for most services. Estimates are provided in good faith based on the information available at the time of inspection. Final pricing may vary if additional work or unforeseen conditions are discovered during service performance.

5. SCHEDULING AND APPOINTMENTS

6. PAYMENT TERMS

6.1 Payment Methods: We accept cash, checks, and major credit cards.

6.3 Late Payments: Accounts not paid within thirty (30) days of invoice date may be subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by California law, whichever is less.

7. WARRANTIES AND GUARANTEES

7.2 Workmanship Warranty: We warrant that all work performed will be completed in a professional and workmanlike manner in accordance with industry standards. Our workmanship warranty covers defects in our work for a period of ninety (90) days from the date of service completion.

8.1 Maximum Liability: TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

8.2 Consequential Damages: WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. CUSTOMER RESPONSIBILITIES

9.1 Accurate Information: You agree to provide accurate and complete information regarding the services required and the condition of your property.

9.2 Permits and Approvals: Unless specifically agreed otherwise in writing, Customer is responsible for obtaining all necessary permits, approvals, and permissions required for the work. We can assist with permit applications for an additional fee.

9.3 Safety: Customer must inform us of any known hazards, including but not limited to asbestos, lead paint, mold, or structural defects.

9.4 Property Protection: Customer is responsible for moving or protecting valuable items, furniture, or belongings in the work area.

9.5 Pets: Customer must secure all pets during service visits to ensure the safety of our technicians.

10. INSURANCE AND LICENSING

Hailey’s Pro Services maintains appropriate liability insurance and complies with all California contractor licensing requirements. Proof of insurance and licensing is available upon request.

11. EMERGENCY SERVICES

11.1 Availability: We offer 24/7 emergency services for urgent repairs. Emergency service rates may be higher than standard rates.

11.2 Response Time: While we strive to respond to emergencies as quickly as possible, response times may vary based on technician availability, location, and weather conditions.

11.3 Safety First: In emergency situations where immediate safety concerns exist, we reserve the right to perform necessary temporary repairs to prevent further damage or injury.

12. MAINTENANCE PROGRAMS

12.1 Program Terms: Customers enrolled in our Maintenance Program agree to the terms and conditions specific to that program, including scheduled service visits, payment terms, and program benefits.

15.4 Small Claims Court: Nothing in this section prevents either party from seeking relief in small claims court for disputes within that court’s jurisdiction.

15.5 Legal Fees: In any legal proceeding arising from these Terms, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.

16. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

You agree to indemnify, defend, and hold harmless Hailey’s Pro Services, its officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:
